Welcome to Trivxia. These Terms of Service govern your access to and use of our website, products, services, and related communications.

Throughout these Terms, “Trivxia,” “we,” “us,” and “our” refer to Trivxia. “You” and “customer” refer to any person who visits our website, places an order, or uses our services.

By accessing our website or purchasing from us, you agree to these Terms of Service, our Refund, Return, and Cancellation Policy, our Shipping Policy, and our Privacy Policy.

Please do not use our website or place an order if you do not agree to these terms.

1. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to make a purchase from Trivxia.

By placing an order, you confirm that:

  • You are legally permitted to enter into a binding agreement.

  • The information you provide is accurate and complete.

  • You are authorized to use the selected payment method.

  • You are purchasing our products for lawful purposes.

  • You have reviewed the product description and applicable store policies.

We may refuse or cancel an order when we reasonably believe it was placed fraudulently, unlawfully, by an unauthorized person, or in violation of these Terms.

2. Product Information

We make reasonable efforts to display product descriptions, photographs, dimensions, colors, features, and other information accurately.

However, product appearance may vary slightly because of:

  • Screen or device settings

  • Printing or manufacturing variations

  • Lighting used in product photography

  • Production updates

  • Differences in materials or production batches

  • Minor formatting or color variations

Minor variations that do not materially affect a product’s intended use are not considered defects.

Customers are responsible for reviewing all product details before completing a purchase.

3. Made-to-Order Products

Certain Trivxia products, including our printed books and educational materials, may be prepared, printed, assembled, or produced after an order is placed.

Production may begin shortly after payment is received. Once processing or production begins, the order may not be canceled, modified, returned, or refunded except as required by applicable law or expressly permitted under our Refund, Return, and Cancellation Policy.

4. Educational and Informational Disclaimer

Trivxia products may contain educational, academic, healthcare-related, nursing-related, or professional-development information.

Our products are intended solely for general educational and informational purposes. They are not a substitute for:

  • Professional medical advice

  • Diagnosis or treatment

  • Clinical supervision

  • Formal education or accredited coursework

  • Legal or regulatory guidance

  • Official testing materials

  • Certification requirements

  • Employer policies

  • Professional judgment

No Trivxia product guarantees that a customer will pass an examination, receive a license, obtain employment, earn a particular grade, or achieve a particular professional outcome.

Customers and healthcare professionals remain solely responsible for verifying information against current clinical guidelines, laws, regulations, institutional procedures, and professional standards before relying on or applying it.

Do not disregard qualified medical advice or delay seeking professional care because of information contained in one of our products.

5. Pricing and Availability

Prices, promotions, product availability, and product descriptions may change without notice.

We reserve the right to:

  • Correct pricing or product-information errors

  • Change or discontinue products

  • Limit quantities

  • Reject bulk or reseller orders

  • Cancel orders affected by material errors

  • End promotional offers at any time

If an order is canceled because of a material pricing error or because we cannot supply the ordered product, we will issue any refund required by applicable law.

Prices do not include taxes, customs charges, duties, or other fees unless expressly stated at checkout.

6. Orders and Acceptance

Submitting an order does not guarantee acceptance.

An order is accepted when we approve payment and begin processing or production. An automated order-confirmation message only confirms that we received the order request.

We may refuse, limit, or cancel an order because of:

  • Suspected fraud

  • Unauthorized payment activity

  • Incorrect pricing or product information

  • Product unavailability

  • Unusually large order quantities

  • Resale activity

  • Previous policy violations

  • Abusive or threatening behavior

  • An incorrect or incomplete address

  • Technical or payment-processing errors

When legally required, amounts paid for a canceled order will be returned to the original payment method.

7. Payment Information

You agree to provide current, complete, and accurate billing and payment information.

By submitting payment information, you represent that:

  • You are the authorized cardholder or account holder.

  • You authorize us and our payment providers to process the transaction.

  • The billing information provided is accurate.

  • Sufficient funds or credit are available.

We may use third-party payment processors. Trivxia does not control your bank’s authorization decisions, processing delays, currency conversion, or payment-provider fees.

8. Taxes, Duties, and Customs Charges

Customers are responsible for applicable sales taxes, import duties, customs charges, brokerage charges, and government-imposed fees unless they are collected at checkout or applicable law requires otherwise.

International customers are responsible for determining whether an ordered product may lawfully be imported into their country.

Refusal to pay customs duties or collect a shipment does not automatically qualify the order for a refund.

9. Shipping and Delivery

Most orders are estimated to arrive within 10–15 business days from the date the order is placed.

Business days exclude weekends and recognized holidays. Delivery timeframes are estimates and are not guaranteed unless expressly stated otherwise.

Shipping may be affected by production volume, carrier congestion, weather, holidays, customs inspections, regional disruptions, incorrect addresses, or circumstances outside our reasonable control.

If we cannot ship an order within the promised timeframe, we will provide any notice, revised shipping estimate, cancellation opportunity, or refund required by applicable law.

Complete shipping terms are contained in our Shipping Policy, which is incorporated into these Terms by reference.

10. Tracking Information

Tracking information may take several business days to update after a shipping label is created.

Statuses such as “label created,” “shipment information received,” or limited tracking movement do not necessarily mean that the package has not entered processing or the shipping network.

Customers are responsible for monitoring tracking information and checking their email, spam folder, and promotional folder for shipping updates.

11. Address Responsibility

Customers must provide a complete and accurate delivery address.

Trivxia is not responsible for delays, failed deliveries, returned packages, or losses caused by:

  • Incorrect street addresses

  • Missing apartment or unit numbers

  • Incorrect postal codes

  • Outdated addresses

  • Misspelled recipient information

  • Delivery restrictions not disclosed to us

  • Failure to collect or accept a package

We cannot guarantee that an address can be changed after an order is placed.

Additional shipping and handling charges may apply when a returned package must be reshipped.

12. Delivered Packages

An order will generally be considered delivered when carrier tracking confirms delivery to the address provided at checkout.

Customers should check the delivery area, mailbox, household members, neighbors, front desk, property manager, and carrier before reporting a package missing.

Trivxia is not responsible for theft, loss, or damage occurring after a package has been correctly delivered, except where applicable law requires otherwise.

13. Returns, Refunds, and Cancellations

Returns, refunds, replacements, and cancellations are governed by our Refund, Return, and Cancellation Policy.

Unless otherwise required by law:

  • Made-to-order products are final sale once processing or production begins.

  • Cancellation requests must be submitted within two hours of ordering.

  • A cancellation request is not approved until confirmed by us in writing.

  • Unauthorized returns will not automatically receive a refund.

  • Original and return shipping charges may be nonrefundable.

  • Customers must report materially damaged, defective, incorrect, or incomplete orders within five calendar days of confirmed delivery.

  • Evidence such as photographs of the product, packaging, and shipping label may be required.

  • Items that have been used, written in, altered, discarded, or damaged after delivery may be ineligible for return or replacement.

Nothing in these Terms eliminates a non-waivable consumer right provided by applicable law.

14. Chargebacks and Payment Disputes

Customers agree to contact us at admin@trivxia.com and provide a reasonable opportunity to investigate and resolve an order concern before initiating a chargeback or payment dispute.

This provision does not prevent a customer from exercising any legal payment-dispute rights.

When a dispute is filed, we may submit relevant evidence to the payment provider, including:

  • Order records

  • Policy acceptance records

  • Website and checkout information

  • Payment verification

  • Customer communications

  • Production and fulfillment records

  • Tracking information

  • Delivery confirmation

  • Photographs or claim documentation

Submitting knowingly false information, falsely claiming an authorized transaction was unauthorized, or falsely claiming a delivered product was never received may result in cancellation of pending orders, refusal of future service, and other lawful remedies.

15. Prohibited Uses

You may not use our website, products, or services to:

  • Violate any law or regulation

  • Commit or facilitate fraud

  • Submit false payment or identity information

  • Interfere with the website’s operation or security

  • Introduce malware, harmful code, or automated attacks

  • Scrape, copy, reproduce, or commercially exploit our website without authorization

  • Impersonate another person or organization

  • Infringe intellectual-property or privacy rights

  • Submit abusive, threatening, discriminatory, or unlawful content

  • Circumvent purchase limits or security measures

  • Resell or redistribute our content without written authorization

We may suspend access, cancel orders, or refuse future service when these restrictions are violated.

16. Intellectual Property

All content made available by Trivxia—including books, study materials, text, graphics, illustrations, designs, worksheets, photographs, videos, product names, logos, page layouts, and downloadable materials—is owned by or licensed to Trivxia and is protected by applicable intellectual-property laws.

Purchasing a product grants you a limited, personal, nonexclusive, nontransferable license to use it for your own lawful, noncommercial purposes.

You may not, without prior written permission:

  • Copy or reproduce our materials

  • Scan or digitize printed materials for distribution

  • Upload our content to shared drives or websites

  • Sell or redistribute copies

  • Modify and resell our content

  • Use our materials to create competing products

  • Remove copyright or ownership notices

  • Share digital access with unauthorized users

  • Use our branding in a way that implies endorsement or affiliation

Unauthorized reproduction or distribution may result in account restrictions and legal action.

17. User Content and Reviews

When you submit a review, photograph, comment, testimonial, suggestion, or other content to Trivxia, you confirm that you own the content or have permission to submit it.

You grant Trivxia a nonexclusive, worldwide, royalty-free license to display, reproduce, edit, and use that content in connection with our website, customer service, advertising, and business operations, subject to applicable privacy law.

We may remove content that is false, unlawful, threatening, obscene, infringing, misleading, or unrelated to the product or service being reviewed.

We will not require customers to waive rights regarding honest reviews as a condition of purchasing from us.

18. Third-Party Services and Links

Our website may contain links to or integrations with third-party services, including payment processors, shipping carriers, analytics providers, social-media platforms, and Shopify.

We do not control and are not responsible for third-party websites, services, availability, security, policies, or content.

Your use of a third-party service may be governed by separate terms and policies issued by that provider.

19. Website Availability

We do not guarantee that the website will always be uninterrupted, error-free, secure, or available.

We may modify, suspend, restrict, or discontinue any website feature or service for maintenance, security, operational, or business reasons.

We are not responsible for losses caused solely by temporary website interruptions except where liability cannot legally be excluded.

20. Disclaimer of Warranties

To the fullest extent permitted by law, our website and services are provided on an “as is” and “as available” basis.

Except for warranties that cannot legally be excluded, Trivxia disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

This section does not limit rights relating to products that are materially defective, incorrect, or otherwise protected by applicable consumer law.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Trivxia and its owners, employees, contractors, suppliers, service providers, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of our website or products.

This may include lost profits, lost business opportunities, lost data, examination results, employment decisions, professional decisions, or reliance on educational information.

To the fullest extent permitted by law, Trivxia’s total liability arising from a specific order will not exceed the amount actually paid to Trivxia for that order.

These limitations do not apply where liability cannot lawfully be limited or excluded.

22. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Trivxia and its owners, employees, contractors, service providers, and affiliates from third-party claims, damages, liabilities, and reasonable expenses arising from:

  • Your unlawful use of our website or products

  • Your violation of these Terms

  • Your infringement of another person’s rights

  • Fraudulent information submitted by you

  • Unauthorized copying or distribution of our content

This section does not require a consumer to indemnify Trivxia for Trivxia’s own unlawful conduct.

23. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By submitting information through our website, you acknowledge that information may be processed by service providers necessary to operate the store, process payments, prevent fraud, fulfill orders, provide tracking, and communicate with customers.

24. Electronic Communications

By placing an order or contacting us electronically, you consent to receive transactional communications relating to your purchase, including:

  • Payment notifications

  • Production updates

  • Shipping and tracking notices

  • Customer-service messages

  • Policy or safety notifications

26. Termination

We may restrict access, cancel pending transactions, or refuse future service when a customer:

  • Misuses payment-dispute procedures

  • Infringes our intellectual property

  • Creates an unreasonable security or legal risk

Termination does not eliminate obligations that arose before termination.

27. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

28. No Waiver

Failure to enforce a provision of these Terms does not waive our right to enforce it later.

29. Entire Agreement

These Terms, together with our Refund, Return, and Cancellation Policy, Shipping Policy, Privacy Policy, and any order-specific terms displayed at checkout, form the entire agreement between you and Trivxia concerning your use of our website and purchase of our products.

30. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where the mandatory consumer laws of another jurisdiction apply.

Nothing in this section prevents a customer from exercising a legal right that cannot be waived.
